Jullie hebben er vaak over gesproken maar de situatie wordt er niet beter op. Uiteindelijk meld je je ziek. Je gaat naar de bedrijfsarts en die geeft het advies om toch weer met elkaar in gesprek te gaan en te onderzoeken of er een oplossing mogelijk is, wellicht met een mediator erbij. Er is volgens de bedrijfsarts sprake van een arbeidsconflict of van een werk gerelateerd verzuim.<\/p>\n\n\n\n<div style=\"height:5px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"has-ast-global-color-8-color has-text-color wp-block-heading\" id=\"meewerken-verstandig-of-niet\"><strong>Meewerken verstandig of niet?<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:16px\">Mediation is op vrijwillige basis. Je hoeft dus niet mee te werken aan mediation.<br>De werkgever zal zeker het advies van de bedrijfsarts volgen en je laten weten dat ze zullen meewerken aan mediation. De werkgever zal de mediation kosten betalen en stelt 3 mediators voor waaruit de werknemer kan kiezen. Je kan overigens ook zelf een mediator voorstellen. Het is goed te bedenken of je wel of niet zal meewerken aan mediation om tot een oplossing van het arbeidsconflict te komen.<\/p>\n\n\n\n<div style=\"height:5px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:16px\">Het niet meewerken aan mediation kan averechtse gevolgen hebben voor zowel de werkgever als de werknemer als het tot een rechtszaak gaat komen.<\/p>\n\n\n\n<div style=\"height:5px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:16px\">Het goede van mediation is dat er een mogelijke oplossing gevonden kan worden maar ook dat de mediation door betrokken partijen gestopt kan worden, ook door de mediator. Is er een oplossing gevonden dan kan er een vaststellingsovereenkomst (VSO) opgesteld worden. Dit kan een VSO zijn betreffende de gemaakte afspraken om weer aan het werk te gaan of een arbeidsrechtelijke VSO tot be\u00ebindiging van de arbeidsovereenkomst.<\/p>\n\n\n\n<div style=\"height:5px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:16px\">Is de mediation gestopt zonder oplossing dan zal het waarschijnlijk uitdraaien op een rechtszaak waarbij betrokken partijen hun eigen kosten dragen. Deze kosten kunnen hoog oplopen. Een advocaat alleen al zal tussen de 20 en 50 uur bezig zijn tegen een gemiddeld tarief van \u20ac 200,00 en daar komt dan nog bij de deurwaarder- en griffiekosten, dat kan al snel oplopen tot \u20ac 10.000,00.<\/p>\n\n\n\n<div style=\"height:5px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:16px\">Het is dus altijd beter om te kiezen voor mediation in plaats van een rechtszaak.
