Je hebt je best gedaan en  alles gegeven tijdens de\u00a0arbeidsmediation. Jullie komen niet tot een oplossing en hebben beide uitgesproken dat het beter is om uit elkaar te gaan. Dat is natuurlijk geen prettig moment. Het is echter wel een oplossing voor het conflict wat jullie hebben. Tijdens dit gesprek zal ik vertellen hoe arbeidsmediation in werk gaat. Ik sta open voor eventuele vragen. Als partijen verder willen met de mediation wordt er een afspraak gepland. Beide partijen kunnen elkaar aanhoren en in gesprek komen over het conflict.\u00a0Wel onder mijn begeleiding. Bijvoorbeeld werkhervatting (andere afdeling, andere locatie, andere functie) of re-integratie.<br>&#8211; Werkgever en werknemer be\u00ebindigen de arbeidsovereenkomst. Je kent elkaars zwakheden en de onderhandelingsruimte is ook bekend bij partijen. Tijdens een rechtelijke procedure mag niets van wat besproken is tijdens de mediation openbaar gemaakt worden.<br>&#8211; Mediation heeft geld gekost. In plaats van het arbeidsconflict verder te laten escaleren, wordt er gekeken naar wat de partijen bindt. Welke oplossing is voor beide partijen het meeste geschikt in hun eigen situatie. Het verleden speelt alleen dan een rol wanneer het een functie heeft om tot erkenning van elkaars belang en verbetering van de onderlinge communicatie te komen. Dat is heel wat sneller dan het aangaan van een juridische procedure waarbij je een rechter of arbiter inschakelt. Juridische procedures kunnen vaak vele maanden duren. In een rechtszaak betalen beide partijen ieder hun eigen advocaat. Bij arbeidsmediation is slechts \u00e9\u00e9n mediator betrokken. Meestal neemt het bedrijf de mediation kosten voor haar rekening.
