Jullie hebben je best gedaan om een oplossing te vinden. Helaas is dat niet gelukt. En wat dan? Je hebt je best gedaan als werkgever en je hebt alles gegeven als werknemer tijdens de&nbsp;arbeidsmediation. Jullie komen niet tot een oplossing en hebben beide uitgesproken dat het beter is om uit elkaar te gaan.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:50%\">\n<p class=\"has-ast-global-color-8-color has-text-color wp-block-paragraph\" style=\"font-size:15px\">Dat is natuurlijk geen leuk moment. Het is echter wel een oplossing voor het conflict wat jullie hebben. Jullie willen de arbeidsovereenkomst ontbinden. De mediation gaat over in exit-mediation. Het is voor zowel de werkgever als werknemer verstandig om je te laten bijstaan door een jurist die gespecialiseerd is in arbeidszaken.&nbsp;<\/p>\n\n\n\n<div style=\"height:5px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Als werkgever en werknemer er mee instemmen kunnen de juristen aanwezig zijn tijden de exit-mediation. De juristen hebben daarbij dezelfde geheimhoudings verplichting als de betrokken partijen. Eerst moeten de te bespreken punten op de agenda gezet worden. Wat zijn dat zoal:<\/p>\n\n\n\n<div style=\"height:5px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<ul class=\"wp-block-list\"><li>einddatum<\/li><li>transitie vergoeding<\/li><li>eindafrekening<\/li><li>vrijstelling van werkzaamheden<\/li><li>het concurrentie- en\/of relatiebeding<\/li><li>de finale kwijting<\/li><li>het geheimhoudingsbeding<\/li><li>getuigschrift<\/li><li>de bedenktijd<\/li><li>opzegtermijn<\/li><li>het recht op WW doordat de werkgever het initiatief tot be\u00ebindigen van het arbeidscontract heeft genomen<\/li><\/ul>\n\n\n\n<div style=\"height:5px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Stuk voor stuk worden de bovenstaande punten besproken. Tijdens exit-mediation wordt er natuurlijk stevig onderhandeld.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:50rem\">\n<h3 class=\"has-ast-global-color-8-color has-text-color wp-block-heading\" id=\"this-can-be-secondary-heading\"><strong>AKKOORD BEREIKT!<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:15px\">Er is door jullie op alle punten een akkoord bereikt. De afspraken zijn gemaakt en akkoord. Het is belangrijk om alle punten goed op papier te zetten. Dit is dan de VSO, een arbeidsrechtelijke vaststellings-overeenkomst. Er is geen onduidelijkheid meer.<\/p>\n\n\n\n<div style=\"height:5px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">De mediator, of een van de juridische vertegenwoordigers kan deze arbeidsrechtelijke vaststellingsovereenkomst maken. Meestal wordt deze door de jurist van de werkgever gemaakt. Zowel de mediator als de jurist van de werknemer doet een controle of alles goed is weergegeven en niets is vergeten.<\/p>\n\n\n\n<div style=\"height:5px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Als alles in orde is dan is dat het moment dat betrokken partijen tot ondertekenen overgaan. Alleen de betrokken partijen ondertekenen, de mediator niet. Hij heeft het proces begeleidt om te komen tot een oplossing van het conflict maar is geen partij. <\/p>\n\n\n\n<div style=\"height:5px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Na ondertekening is het belangrijk om elkaar de hand te schudden, misschien niet zo makkelijk maar wel goed om te doen.<\/p>\n\n\n\n<div style=\"height:5px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Exit-mediation kost veel energie van partijen. Er zijn weken, misschien wel maanden overheen gegaan voordat men het eens was. Een moment van rouw is daar.
